General terms and conditions of sale

Article 1: General provisions

The e-commerce website of AQwaTech BV with registered office at Bevrijdingsweg 18, B-8480 Bekegem, VAT BE 0555.711.515, offers its customers the opportunity to purchase the products from its web store online.

These Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through AQwaTech BV’s online store, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by AQwaTech BV.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and any other taxes or duties that the Customer is obliged to pay.

Shipping costs are listed separately at the end of the ordering process. The overview of shipping costs can be found below.

The statement of price refers only to the items as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are compiled with the utmost care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind AQwaTech BV. AQwaTech BV is as to the accuracy and completeness of the information offered only to a means obligation. AQwaTech BV shall in no case be liable in case of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Customer to contact us in advance.

The offer is always valid while stocks last and may be modified or withdrawn by AQwaTech BV at any time. AQwaTech BV cannot be held liable for the unavailability of any product. If an offer has a limited period of validity or is made subject to conditions, this shall be expressly stated in the offer.

Article 4: Online purchases - Description of the ordering process

Below is a description of the ordering process of our web shop. This will briefly and concisely explain the steps you need to take to place an order, how to checkout and the confirmation emails you will receive.

Step 1: The product

Once you have found the desired product, possibly selected the desired features, and possibly adjusted the quantity, click the “Add to Cart” button in the product page. Now your selected product will be added to the shopping cart. You can add other products to your shopping cart in the same way or go to the cart to checkout.

Step 2: The cart

If you wish to checkout your order, first check your products in the shopping cart, adjust quantities if desired, then click Update Cart and click the Proceed to Checkout button. You will now be redirected to the checkout page.

Step 3: Checkout

You are now on the checkout page. Here you need to enter your data (“Billing Address”).Afterwards, click “Continue.” In the next screen, you may be able toenter a different shipping address. If you do not enter anything here, the products will be sent to the billing address. Afterwards, click “Continue.” Then you can select your shipping method. Shipping costs and the minimum amount for free shipping vary by country. You can find the overview in the table below:

Now you can check your order, agree to the terms and conditions by checking the box next to “I have read and agree to the terms and conditions of the website” and finally you can place the order. To do so, click on “place order.”

Step 4: Payment

You will now be redirected to the secure payment page of our payment provider SISOW. Here you need to follow the instructions of the respective website to complete the payment.

Step 5: We have received your order

You have now placed your order and it has been received by us.

You will then receive an email from us confirming your order. Your order has now reached us and will be further processed and prepared for shipment.

AQwaTech BV is entitled to refuse an order pursuant to a serious breach by the Customer in relation to orders involving the Customer.

Step 6: Shipment

Once we receive payment, the ordered products will be shipped to you within 1-3 business days. As soon as the order is shipped, you will also receive an email from us (via shop@aqwatech.com) with the tracing link so you can track your order.

Article 5: Delivery and execution of the agreement

Unless otherwise agreed or expressly provided, the goods shall be delivered to the Customer at the latest within 30 days after receipt of the order.

Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery, must be reported by the Customer to AQwaTech BV without delay.

Risk for loss or damage shall pass to the Customer as soon as he (or a third party designated by him, who is not the carrier) takes physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by the AQwaTech BV.

Article 6: Reservation of ownership

The delivered items remain the exclusive property of AQwaTech BV until full payment by the Customer.

The Customer undertakes to point out the retention of title of AQwaTech BV to third parties if necessary, e.g. to anyone who would come to seize the not yet fully paid items.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from AQwaTech BV in their capacity as consumers.

The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons. The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.

To exercise the right of withdrawal, the Customer must inform AQwaTech BV (Bevrijdingsweg 18, B-8480 Bekegem, info@penta-power.com, +32 (0)50 69 02 45) of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to AQwaTech BV (Bevrijdingsweg 18, B-8480 Bekegem) without delay, but in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw from the contract to AQwaTech BV. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned product is somehow diminished in value, AQwaTech BV, reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer withdraws from the Agreement, AQwaTech BV will refund to the Customer all payments received from the Customer up to that point, including standard delivery charges, within a maximum of 14 calendar days after AQwaTech BV is informed of the Customer’s decision to withdraw from the Agreement. For sales contracts, AQwaTech BV may wait to refund until it has received back all the goods, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer’s choice of a mode of delivery other than the cheapest standard delivery offered by AQwaTech BV shall not be refunded.

AQwaTech BV will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refund.

The Customer cannot exercise the right of withdrawal for:

  • the delivery of goods manufactured to the Customer’s specifications, or which are clearly intended for a specific person;
  • the delivery of goods that spoil quickly or have a limited shelf life;
  • the delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and whose seal has been broken after delivery;
  • the supply of goods which, after delivery, are by their nature irrevocably mixed with other products;

Article 8: Warranty

Under the Act of September 21, 2004 on the Protection of Consumers in the Sale of Consumer Goods, consumers have legal rights. This legal warranty is valid from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer must contact AQwaTech BV and return the item to AQwaTech BV at the Customer’s expense.

If a defect is found, the Customer must notify AQwaTech BV as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Thereafter, any right to repair or replacement shall expire.

The warranty never applies to defects caused by accidents, neglect, falls, use of the item contrary to purpose for which it was designed, non-compliance with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if any, delivery, shall be deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Penalties for non-payment

Without prejudice to the exercise of any other rights available to AQwaTech BV, in the event of non-payment or late payment, the Customer shall owe interest of 10% per annum on the unpaid amount by operation of law from the date of the default and without notice. In addition, the Customer shall owe, ipso jure and without formal notice, a fixed indemnity of 10% on the amount involved, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, AQwaTech BV reserves the right to take back items not (fully) paid for.

Article 13: Infringement of validity - non-violation

If any provision of these Terms is declared invalid, illegal or null and void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by AQwaTech BV to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 14: Modification of conditions

These Terms are supplemented by other terms and conditions expressly referred to, and the general terms and conditions of sale of AQwaTech BV. In case of contradiction, these Terms take precedence.

Article 15: Evidence

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - competent court

Belgian law applies, with the exception of the provisions of international private law on applicable law.

All disputes are subject to the exclusive jurisdiction of the courts having jurisdiction over our registered office. The Consumer can also turn to the ODR platform(http://ec.europa.eu/consumers/odr/), however, we reserve the right to submit disputes exclusively to the courts.
